1. Introduction
These Terms and Conditions ("Terms") govern your use of the website and online donation platform operated by MCKS Food For The Hungry Foundation Cochin ("Foundation"), a charitable trust registered under the Indian Trusts Act, 1882, with its registered office at Kadavanthra, Kochi – 682020, Kerala, India. By accessing or using this website, you agree to be bound by these Terms.
2. About the Foundation
The Foundation is a registered charitable trust engaged in providing food and essential support to the underprivileged. The Foundation holds valid registrations under Section 12AB and Section 80G of the Income Tax Act, 1961, enabling it to receive tax-exempt donations.
3. Eligibility to Donate
By making a donation through this platform, you confirm that:
- You are at least 18 years of age and legally competent to enter into a binding agreement.
- The funds being donated are from a legitimate source and are not derived from any illegal activity.
- Indian Residents: Your donation is subject to the provisions of the Income Tax Act, 1961.
- Foreign Donors: Your donation is subject to the provisions of the Foreign Contribution (Regulation) Act, 2010 (FCRA). The Foundation can only accept foreign contributions if it holds a valid FCRA registration. If the Foundation's FCRA registration is not active, we cannot accept donations from foreign nationals, foreign entities, or NRIs holding foreign citizenship.
- All information provided by you (including name, PAN, address, and nationality) is true, accurate, and complete.
4. Donations
All donations made through this platform are voluntary contributions to the Foundation's charitable activities.
- Donations are processed in Indian Rupees (INR).
- You may allocate your donation across specific categories or programs as offered on the platform. The Foundation reserves the right to redirect funds to similar programs if a specific category is fully funded or discontinued.
- A donation receipt will be issued for every successful transaction.
- Donations above ₹2,000 must be made via electronic means (bank transfer, UPI, or online payment) as per Section 80G requirements. Cash donations above ₹2,000 are not eligible for 80G tax exemption.
5. 80G Tax Exemption Receipts
The Foundation is registered under Section 80G of the Income Tax Act, 1961, and donors are eligible for tax deduction on their donations, subject to the following conditions:
- You must provide a valid PAN (Permanent Account Number) for donations exceeding ₹50, as mandated by Rule 18AB.
- 80G certificates (Form 10BE) are generated annually and made available to donors after the Foundation files Form 10BD with the Income Tax Department.
- The tax deduction is subject to the limits and conditions specified under Section 80G. The Foundation does not provide tax advice — please consult your tax advisor.
- If a donation is refunded, the corresponding 80G receipt will be cancelled and the Form 10BD filing will be amended accordingly.
6. User Accounts
To make a donation, you must create an account on our platform. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. The Foundation is not liable for any loss arising from unauthorized use of your account.
7. Intellectual Property
All content on this website — including text, images, logos, designs, and software — is the property of MCKS Food For The Hungry Foundation Cochin or its licensors and is protected under applicable intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on this website without our prior written consent.
8. Limitation of Liability
The Foundation makes every effort to ensure the accuracy of information on this website. However, we do not warrant that the website will be uninterrupted, error-free, or free from viruses. To the fullest extent permitted by law, the Foundation shall not be liable for any direct, indirect, incidental, special, or consequential damages arising from your use of the website or donation platform, including but not limited to loss of data, loss of revenue, or any technical failures.

12. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Ernakulam, Kerala, India.
